1. WHO IS RESPONSIBLE FOR DATA PROCESSING

The controller responsible for data processing on this website within the meaning of the EU General Data Protection Regulation (GDPR) is:

Beach Tennis 4u GmbH
Managing directors: Maraike Biglmaier, Margarete Pelster
Draisweg 16
12209 Berlin
Germany
E-mail: hello@bt4u.one

The controller is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, e-mail addresses).

2. OVERVIEW

This privacy policy explains which personal data we process when you visit our website, contact us or book one of our camps or events, for what purposes we do so, on which legal basis, and which rights you have.

Personal data is any information that can be used to identify you personally, such as your name, e-mail address or IP address.

We process personal data in accordance with the GDPR, the German Federal Data Protection Act (BDSG) and the German Telecommunications Digital Services Data Protection Act (TDDDG).

3. HOSTING WITH WIX

This website is hosted on the Wix platform. The provider is Wix.com Ltd., 5 Yunitsman St., Tel Aviv, Israel ("Wix").

When you visit our website, Wix processes the data required to deliver the website, in particular your IP address, the date and time of access, browser type and version, operating system, referrer URL and the pages you visit (server log files). This data is technically necessary to display the website to you and to ensure its stability and security.

Wix stores data on servers in various countries and uses sub-processors, some of which are located outside the EU/EEA, including in the USA. The European Commission has issued an adequacy decision for Israel. For transfers to other third countries, Wix relies on the EU standard contractual clauses and, where applicable, the EU-U.S. Data Privacy Framework.

The legal basis is Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website reliably, securely and efficiently. Where you have consented to the storage of or access to information on your device (e.g. cookies), processing is also based on Art. 6(1)(a) GDPR and § 25(1) TDDDG; this consent can be revoked at any time.

We have concluded a data processing agreement with Wix in accordance with Art. 28 GDPR.

4. COOKIES AND CONSENT MANAGEMENT

Our website uses cookies and similar technologies. Cookies are small text files that are stored on your device. Some are deleted when you close your browser (session cookies); others remain on your device until they expire or you delete them (persistent cookies).

Strictly necessary cookies
Some cookies are strictly necessary to operate the website, for example to ensure security, to load the page correctly or to save your cookie settings. These are set on the basis of § 25(2) no. 2 TDDDG and Art. 6(1)(f) GDPR; our legitimate interest is the technically error-free provision of our website. Your consent is not required for these cookies.

All other cookies
All other cookies and similar technologies (e.g. for statistics, marketing or embedded third-party content) are only used if you have given your consent via our cookie banner. The legal basis is § 25(1) TDDDG in conjunction with Art. 6(1)(a) GDPR.

Cookie banner
When you first visit our website, a cookie banner asks for your consent. We use the consent function provided by Wix for this purpose. Your choice is stored in a cookie so that the banner does not appear again on every visit. The legal basis is Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR (obligation to document consent).

You can change or revoke your consent at any time with effect for the future via the link "Cookie settings" in the footer of our website.

You can also configure your browser to block or delete cookies. If you do so, some functions of the website may not work properly.

5. CONTACTING US BY E-MAIL

If you contact us by e-mail (e.g. at hello@bt4u.one or event@bt4u.one), we process the data you provide (e.g. your name, e-mail address and the content of your message) in order to answer your request and for any follow-up questions.

If your request relates to a contract or to pre-contractual measures (e.g. questions about booking a camp), the legal basis is Art. 6(1)(b) GDPR. In all other cases, the legal basis is our legitimate interest in answering requests addressed to us (Art. 6(1)(f) GDPR).

We delete your data as soon as it is no longer required for the purpose for which it was collected, unless statutory retention obligations apply (e.g. for business correspondence under commercial and tax law).

Our e-mails are processed via IONOS as a processor.

6. BOOKINGS FOR CAMPS, TOURNAMENTS AND EVENTS

When you register for one of our camps, tournaments or events, we process the data required to carry out the booking, in particular your name, contact details, booking details, payment information and, where relevant, your playing level or group assignment.

The legal basis is Art. 6(1)(b) GDPR (performance of a contract and pre-contractual measures). Where we are legally obliged to retain data (e.g. invoices), the legal basis is Art. 6(1)(c) GDPR.

We only pass on your data to third parties where this is necessary to carry out the contract, for example to payment service providers or, for ITF tournaments, to the respective tournament organiser or federation. [CHECK: name any other recipients, e.g. partner hotels or a travel agency, if you pass on data to them]

We store your data for as long as it is needed to carry out the contract. Afterwards, we delete it unless statutory retention periods under commercial and tax law apply (generally up to 10 years).

7. CONTACT AND REGISTRATION FORMS

If you send us a message or a registration via a form on our website, we process the data you enter there (e.g. name, e-mail address, message) in order to process your request. The form is provided by Wix; the data is stored on Wix's servers (see section 3).

The legal basis is Art. 6(1)(b) GDPR if your request relates to a contract or pre-contractual measures, and otherwise Art. 6(1)(f) GDPR (legitimate interest in processing requests).

To protect our forms against spam and automated abuse, Wix may use the service Google reCAPTCHA, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. reCAPTCHA analyses certain information (e.g. IP address, mouse movements, time spent on the page) to determine whether an entry is made by a human. Data may be transferred to Google servers in the USA. The legal basis is your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR) or, where no consent is required, our legitimate interest in protection against spam (Art. 6(1)(f) GDPR). [CHECK: whether reCAPTCHA is active on your forms]

We delete your data once your request has been fully processed, unless statutory retention obligations apply.

8. WIX ANALYTICS

We use the statistics functions provided by Wix to analyse how visitors use our website (e.g. pages visited, time spent, device type, approximate location). This helps us improve our website.

Cookies used for this purpose are only set with your consent. The legal basis is § 25(1) TDDDG in conjunction with Art. 6(1)(a) GDPR. You can revoke your consent at any time via the cookie settings.

9. META PIXEL

This website uses the Meta Pixel, provided by Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland ("Meta").

The Meta Pixel allows us to measure the effectiveness of our advertising on Facebook and Instagram and to show our ads to relevant target groups. For this purpose, information about your use of our website (e.g. pages visited, actions taken) is transmitted to Meta and may be linked to your Facebook or Instagram account. Data may be transferred to Meta Platforms Inc. in the USA, which is certified under the EU-U.S. Data Privacy Framework.

For the collection and transmission of the data, we and Meta are joint controllers (Art. 26 GDPR). The further processing by Meta is Meta's sole responsibility. Our agreement with Meta can be found here: https://www.facebook.com/legal/controller_addendum

The Meta Pixel is only used with your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). You can revoke your consent at any time via the cookie settings.

10. NEWSLETTER

If you subscribe to our newsletter, we use your e-mail address and, if provided, your name to send you information about our camps, tournaments and events. We use the double opt-in procedure: after signing up, you will receive an e-mail asking you to confirm your subscription. We log your sign-up and confirmation in order to be able to prove them.

We send the newsletter using ActiveCampaign, provided by ActiveCampaign, LLC, 1 North Dearborn St, Suite 500, Chicago, IL 60602, USA. Your data is stored on ActiveCampaign's servers in the USA. ActiveCampaign is certified under the EU-U.S. Data Privacy Framework. We have concluded a data processing agreement with ActiveCampaign in accordance with Art. 28 GDPR.

Our newsletters contain a small tracking pixel and tracked links. This allows us to see whether a newsletter was opened and which links were clicked, so that we can improve future newsletters. This analysis is part of the consent you give when subscribing. If you do not want it, you can unsubscribe at any time.

More information: https://www.activecampaign.com/legal/privacy-policy

The legal basis is your consent (Art. 6(1)(a) GDPR). You can unsubscribe at any time via the link in every newsletter or by e-mail to us. The lawfulness of processing carried out before your revocation remains unaffected.

After you unsubscribe, we may store your e-mail address in a blocklist to ensure that you do not receive any further newsletters. This is based on our legitimate interest in complying with legal requirements (Art. 6(1)(f) GDPR).

11. PAYMENT

You currently pay for our camps and events by bank transfer. We process your bank details solely to assign and process your payment. The legal basis is Art. 6(1)(b) GDPR (performance of a contract) and, for retaining payment records, Art. 6(1)(c) GDPR in conjunction with statutory retention obligations under commercial and tax law.

12. PHOTOS AND VIDEOS AT OUR EVENTS

At our camps, tournaments and events, we take photos and videos and publish some of them on our website and our social media channels to report on our events and present our offers.

The legal basis is our legitimate interest in reporting on our events and in public relations (Art. 6(1)(f) GDPR). For photos in which individual persons are the main subject, we ask for consent beforehand (Art. 6(1)(a) GDPR). For minors, we obtain the consent of their legal guardians.

If you do not want to be photographed or would like a published photo to be removed, please let us know at any time at hello@bt4u.one.

13. OUR SOCIAL MEDIA PROFILES

We maintain profiles on Instagram and Facebook @bt4u.one. When you visit our profiles or interact with them, the respective platform provider processes your data. For Instagram and Facebook, we and Meta Platforms Ireland Limited are joint controllers for the processing of statistical data about our profile (Art. 26 GDPR). More information: https://www.facebook.com/legal/terms/page_controller_addendum

The legal basis is our legitimate interest in communicating with our community and presenting our offers (Art. 6(1)(f) GDPR). Please note that we have no influence on the data processing by the platform providers. Requests regarding your rights can be made most effectively directly to the respective provider.

14. DATA TRANSFERS TO THIRD COUNTRIES

Some of the service providers named in this privacy policy are based outside the EU/EEA or process data there, especially in the USA. Data is only transferred to a third country if the European Commission has issued an adequacy decision for that country (e.g. for Israel or, for companies certified under the EU-U.S. Data Privacy Framework, the USA), or if appropriate safeguards are in place, in particular the EU standard contractual clauses (Art. 46 GDPR).

15. HOW LONG WE STORE YOUR DATA

Unless a specific storage period is stated in this privacy policy, we only store your personal data for as long as is necessary for the purpose for which it was collected. If you request deletion or revoke your consent, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. retention periods under tax or commercial law). In that case, the data will be deleted once these reasons no longer apply.

16. YOUR RIGHTS

Under the GDPR, you have the following rights regarding your personal data:

- Right of access (Art. 15 GDPR): You can request information about the personal data we process about you.
- Right to rectification (Art. 16 GDPR): You can request that incorrect data be corrected.
- Right to erasure (Art. 17 GDPR): You can request that your data be deleted.
- Right to restriction of processing (Art. 18 GDPR): You can request that the processing of your data be restricted.
- Right to data portability (Art. 20 GDPR): You can request to receive your data in a structured, commonly used and machine-readable format, or to have it transferred to another controller.
- Right to withdraw consent (Art. 7(3) GDPR): You can withdraw any consent you have given at any time with effect for the future. The lawfulness of processing carried out before the withdrawal remains unaffected.

RIGHT TO OBJECT (Art. 21 GDPR)
Where we process your data on the basis of Art. 6(1)(e) or (f) GDPR, you have the right to object to the processing at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

Where we process your data for direct marketing purposes, you have the right to object to this at any time. Your data will then no longer be used for these purposes.

To exercise your rights, simply send an e-mail to hello@bt4u.one.

17. SSL/TLS ENCRYPTION

For security reasons and to protect the transmission of confidential content, such as booking requests that you send to us, this website uses SSL/TLS encryption. You can recognise an encrypted connection by the "https://" in your browser's address bar and the lock symbol.
